DMCA Policy

1. Overview

Zonitel Solutions LLC ("Zonitel") respects the intellectual property rights of others and expects users of its platform to do the same. This Digital Millennium Copyright Act Policy ("DMCA Policy") describes how copyright owners may report alleged infringement occurring through Zonitel's services, and how users may respond to such reports.

Zonitel complies with the notice-and-takedown provisions of the Digital Millennium Copyright Act, 17 U.S.C. § 512 (the "DMCA"), and qualifies for the safe harbor protections set forth therein as a service provider that stores or transmits user-generated content at the direction of users. This policy satisfies our obligation to designate an agent to receive notifications of claimed infringement.

2. Designated DMCA Agent

Zonitel has designated the following agent to receive written notifications of claimed copyright infringement under 17 U.S.C. § 512(c)(2). This designation has been registered with the U.S. Copyright Office as required by law.

Only DMCA-related communications should be sent to this agent. Other inquiries (technical support, billing, sales) sent to this address will not receive a response.

3. Submitting a DMCA Takedown Notice

If you believe that content stored on or transmitted through Zonitel's platform infringes your copyright, you may submit a written DMCA notice to our Designated Agent. To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

  1. Identification of the copyrighted work: A description of the copyrighted work (or a representative list if multiple works) that you claim has been infringed.
  2. Identification of the infringing material: A description of the material on Zonitel's platform that you claim is infringing, with sufficient detail (e.g., URL, account identifier, call recording ID) to allow Zonitel to locate and evaluate the material.
  3. Your contact information: Your name, mailing address, telephone number, and email address.
  4. Statement of good faith: A statement that you have a good faith belief that the use of the disputed material is not authorized by the copyright owner, its agent, or applicable law.
  5. Statement of accuracy: A statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
  6. Your signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Important: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees. If you are unsure whether the material in question infringes your copyright, consult a qualified attorney before submitting a notice.

4. Zonitel's Response to Notices

Upon receipt of a valid DMCA notice, Zonitel will:

  • Promptly remove or disable access to the allegedly infringing material.
  • Make reasonable efforts to notify the user or account holder whose content was removed, providing a copy of the infringement notice.
  • Inform the user of their right to submit a counter-notification under 17 U.S.C. § 512(g).

Zonitel reserves the right to terminate the accounts of users who are found to be repeat infringers, in accordance with our Terms of Use.

5. Submitting a Counter-Notice

If you believe that content Zonitel removed in response to a DMCA notice was removed in error or misidentification, you may submit a written counter-notice to our Designated Agent under 17 U.S.C. § 512(g)(3). Your counter-notice must include all of the following:

  1. Identification of the removed material: A description of the material that was removed and the location (e.g., URL or account location) where it appeared before it was removed.
  2. Statement of good faith: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, any judicial district in which Zonitel may be found), and that you will accept service of process from the person who provided the original DMCA notice.
  4. Your contact information: Your name, address, telephone number, and email address.
  5. Your signature: A physical or electronic signature.

Upon receipt of a valid counter-notice, Zonitel will provide a copy to the original complainant and notify them that the removed material will be restored or re-enabled within 10–14 business days, unless the complainant files a court action against the user and notifies Zonitel. Zonitel may restore the content at its discretion once that period has elapsed and no court action has been initiated.

Important: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material was removed by mistake or misidentification may be liable for damages.

6. Scope — What Zonitel's DMCA Policy Covers

Zonitel's DMCA safe harbor applies to content stored or transmitted through its platform at the direction of users. This may include:

  • Call recordings uploaded or generated by customers through the Zonitel platform.
  • Voicemail recordings stored in customer accounts.
  • Fax documents transmitted or received through Zonitel's digital fax service.
  • SMS/MMS message content stored in customer accounts.
  • Any other user-generated content hosted on Zonitel's infrastructure.

This DMCA Policy does not cover Zonitel's own copyrighted content, including its website, software, logos, marketing materials, or documentation. Unauthorized reproduction or distribution of Zonitel's proprietary content is addressed separately under the Intellectual Property section of our Terms of Use.

7. Repeat Infringer Policy

In appropriate circumstances, Zonitel will terminate the accounts of users who are determined to be repeat infringers of third-party copyrights. A "repeat infringer" is a user whose account has been subject to multiple valid DMCA takedown notices where the user did not successfully challenge the notices through the counter-notice process, or who has been found by a court to have infringed third-party copyrights through use of the Services.
